CHAPTER 7 BANKRUPTCY:


A Chapter 7 Bankruptcy allows the debtor to discharge certain debts in order to give the debtor a "fresh start." After a Chapter 7 bankruptcy has concluded, the debtor will have no liability for discharged debts. CHAPTER 13 BANKRUPTCY:

            A Chapter 13 plan allows for debtors to pay back all or part of their owed debts.  A Chapter 13 will allow the Debtor to consolidate all of their debts and make one monthly payment to the Chapter 13 trustee who will distribute the payments to the creditors.  In a Chapter 13, the debtor’s repayment plan will last anywhere from three (3) to five (5) years.  One benefit to a Chapter 13 Plans is that it offers debtors a way to save their homes from foreclosure.  A Chapter 13 Plan may stop a foreclosure and help the debtor to cure overdue and delinquent payments.
